Privacy Policy
The short version
AwakeMinder exists to record whether a caregiver was awake during an overnight shift, and to raise an alarm when they were not. Doing that requires us to store who was on shift, when we prompted them, whether they answered, and who we contacted when they did not.
We do not sell personal information, and we do not use it for advertising. We share it only with the service providers listed below who help us operate the product.
1. Who we are
AwakeMinder is operated by NightVigil LLC, a limited liability company in the United States ("we", "us"). This policy explains how we handle personal information in the AwakeMinder web application, the AwakeMinder iOS application, and the notifications we send on our customers' behalf.

2. Whose information this covers
Three different groups of people appear in AwakeMinder, and only the first creates an account:
- Account holders. Caregivers, managers and owners who sign in to the app.
- Escalation contacts. Supervisors, managers or family members whose name, phone number and email address are entered by an organization so we can reach them when a check is missed. They are not required to hold an account, and typically do not.
- Care recipients. A schedule in AwakeMinder represents one person receiving overnight care, and organizations commonly name the schedule after that person.
Information about the second and third groups is provided to us by the organization, not by the person it describes. Section 8 explains how that responsibility is divided, and how such a person can reach us.
3. What we collect

We do not ask for, and have no need of, medical records, diagnoses, or care notes. We deliberately do not log passwords, session tokens, or card numbers.
4. How we use it
We use personal information to provide the service and for nothing else. Specifically: to authenticate you; to determine which schedules you may see; to generate and deliver awake checks; to escalate a missed check to the contacts an organization has configured; to keep the timestamped record an organization relies on for its own accountability; to bill for the service; and to operate, secure and troubleshoot the platform.
We do not sell personal information. We do not share it with advertisers, and we do not use it to build profiles for marketing.
5. Messages we send
AwakeMinder sends push notifications, SMS messages, automated phone calls and emails. These are operational messages: a prompt to a caregiver on shift, or an alert to a configured escalation contact when a check is missed. They are not marketing, and we never send promotional text messages.
Text messages are sent only to a person who has turned alert texts on themselves, in their own AwakeMinder account. We record when that consent was given, how, and from what address, so we can evidence it if asked. Message frequency varies — alerts are sent only when a check is missed, so a quiet month produces none. Message and data rates may apply. Reply STOP to any message to end them, or HELP for help. Ending text messages does not remove someone as an escalation contact. An escalation contact who no longer wishes to be contacted at all should ask the organization that listed them to remove them, since the organization controls that list; you may also write to us at support@awakeminder.com and we will help. Because these alerts exist to protect a person receiving overnight care, removing a contact may leave an organization's escalation path incomplete, and we will tell the organization when we act on such a request.
6. Who we share it with
We use the following service providers. Each receives only what it needs to perform its function, and none is permitted to use it for its own purposes.

We may also disclose information where we are legally required to, or where it is necessary to protect someone's safety or to establish or defend a legal claim.
7. Cookies and analytics
This website uses Google Analytics to measure how the marketing pages are used — which pages people read, and how they arrived. It sets cookies in your browser to do that.
We set no analytics cookies unless you agree. Nothing is requested from Google until you choose "Allow analytics" on the banner: not the tag, not a cookieless measurement, nothing. Declining, or simply ignoring the banner, means this site makes no contact with Google at all. Your choice is remembered in your own browser.
You may change your mind at any time, and it is as easy as agreeing was: . Choosing "Reject" stops any further collection; data already gathered while you had agreed is retained for the period in section 8.
The signed-in AwakeMinder application is a separate matter: it carries no analytics or advertising tags. Its pages name the organizations and locations you work with, and that is not information we send to a third party for measurement.
We use no advertising or cross-site tracking cookies anywhere, and we have not enabled Google Signals, which would associate visits with signed-in Google accounts across devices.
8. How long we keep it
Awake checks, escalations and notification records are the evidence an organization may need long after the night in question — for an insurer, a family, or a state audit — so we retain them for the life of the organization's account.
Account information is retained while the account exists. When an organization closes its account we delete or anonymise its data within 90 days, except where we are required to keep records for longer for tax, accounting or legal reasons.
Deleting a schedule inside the product does not erase the checks already recorded against it. That is deliberate: the record of whether someone was awake on a given night is the product's purpose, and it survives the removal of the schedule.
9. Organizations, and the people they enter
When an organization uses AwakeMinder, the organization decides whose names go into it, which escalation contacts to list, and how long to keep using the service. We process that information on the organization's instructions. The organization is responsible for having a proper basis to provide it — including telling care recipients and escalation contacts that their details are held here.
If you believe your information is in AwakeMinder and you did not put it there, write to support@awakeminder.com. We will identify the organization responsible and either act on your request or pass it to them, and we will tell you which.
10. Security
Traffic to AwakeMinder is encrypted in transit with TLS. Data is stored on access-controlled infrastructure and backed up in encrypted form. Authentication is handled by a specialist provider, so we never see or store your password. Access to production data is limited to people who need it to operate the service.
No system is perfectly secure. If a breach affects your information we will notify you and, where required, the relevant authority, without undue delay.
11. Your choices and rights
You may review and correct your own account details in the app at any time. Depending on where you live, you may also have the right to request a copy of your information, ask us to correct or delete it, object to or restrict certain processing, or complain to your data protection authority.
To make a request, email support@awakeminder.com. We will respond within the time your law allows, and we will not treat you differently for asking. Where the information belongs to an organization's account, we will route your request as described in section 9. 12. Children
AwakeMinder is not directed at children and account holders must be adults. A care recipient named on a schedule may be a minor, for example where an organization provides pediatric home nursing; in that case the organization is responsible for the consent of a parent or guardian.
13. International transfers
We operate in the United States, and information you provide is stored and processed there. If you use AwakeMinder from elsewhere, you are sending your information to the United States, which may have different data protection rules from your own country.
14. Changes to this policy
If we make a material change we will update the date at the top of this page and notify account holders by email or in the app before it takes effect. Continuing to use AwakeMinder after that means you accept the revised policy.
